I have a question -herpes transmission

From all the information that I have gathered - Herpes is acquired from skin to skin contact.

So if for example I have mild symptoms on my genitals and my partner touched me down there - shoudnt he get it on his hands?

Lets say Im having an outbreak right now (a mild one but still an outbreak) isnt the situation just the same if i had unprotected sex with a partner and him touching me down there? -since its skin to skin, im assuming the virus will attach itself to the hands or penis (?) Im just asking.

No, not necessarily.

The circumstances have to be just right which is why it's a lot more common to pass or contract herpes via kissing or sex.

Again ~ the circumstances have to be just right. There has to be an opening in the skin, active herpes virus on the surface and a way to enter the opening.
